Acceptance of Terms

By accessing and using the services provided by newspakcct B.V. ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of our website, booking platform, and culinary tour services.

If you do not agree to abide by the above, please do not use our services or access our website.

Service Description

newspakcct provides culinary tourism services including but not limited to:

• Walking food tours and culinary experiences
• Cooking classes and workshops
• Wine and food pairing sessions
• Market tours and tastings
• Custom culinary experiences and private group tours

Booking and Payment Terms

When you book a service with newspakcct, you agree to the following terms:

• All bookings must be confirmed in writing via email
• Payment is required at the time of booking unless otherwise agreed
• Prices are quoted in Euros and include applicable VAT
• We reserve the right to modify prices with 30 days' notice
• Group bookings may require a deposit with balance due before the tour date

Cancellation and Refund Policy

Our cancellation policy is as follows:

• Cancellations made 48 hours or more before the scheduled tour: Full refund
• Cancellations made within 48 hours: 50% refund
• No-shows or cancellations on the day of the tour: No refund
• Weather-related cancellations by newspakcct: Full refund or rescheduling at no charge
• Refunds will be processed within 14 business days to the original payment method

Participant Responsibilities

As a participant in newspakcct tours and experiences, you agree to:

• Arrive on time for scheduled tours and activities
• Inform us of any dietary restrictions, allergies, or mobility issues
• Behave respectfully towards guides, venues, and other participants
• Follow safety instructions and guidelines provided by our staff
• Not consume excessive alcohol during tours
• Be responsible for your personal belongings

Health and Safety

Your safety is our priority. Please note:

• Participants must inform us of any food allergies or dietary restrictions
• We cannot guarantee allergen-free environments at all venues
• Participants with severe allergies participate at their own risk
• Tours involve walking and may not be suitable for those with mobility issues
• Participants must be in reasonable physical condition

Intellectual Property

All content on the newspakcct website, including but not limited to text, graphics, logos, images, and software, is the property of newspakcct B.V. or its content suppliers and is protected by Dutch and international copyright laws.

You may not reproduce, distribute, display, or create derivative works from any content without our express written permission. Tour routes, venue selections, and itineraries are proprietary to newspakcct and may not be copied or used for commercial purposes.

Photography and Privacy

During tours, newspakcct may take photographs or videos for marketing purposes. By participating in our tours, you consent to being photographed and to the use of your likeness in our promotional materials. If you prefer not to be photographed, please inform your guide at the start of the tour.

Limitation of Liability

newspakcct B.V. shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, including but not limited to damages for loss of profits, use, data, or other intangibles.

Our total liability for any claim arising from or relating to these terms shall not exceed the amount paid by you for the specific service giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based.

Force Majeure

newspakcct shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government regulations.

Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of our services, to understand our practices regarding the collection and use of your personal information.

Termination

newspakcct reserves the right to terminate or suspend your access to our services immediately, without prior notice, if you breach these Terms of Service or engage in conduct that we deem inappropriate or harmful to our business or other participants.

We may also cancel tours due to insufficient bookings, safety concerns, or operational issues. In such cases, full refunds will be provided.

Modifications to Terms

newspakcct reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the Dutch courts, specifically the courts of North Brabant, Netherlands.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms shall remain in full force and effect.
